关于misdemeanor battery案子后续

感谢大家慷慨解囊和热心帮助。我其实已经是偏向于法官对我的判决，12节 angry management课程和3年probation。但是我男朋友希望我继续打下去，上陪审团什么的。可是律师建议我说认就好了，上陪审团不一定会赢，因为有目击者，另外还有至少7500块钱的上庭费，并且charge我的不会是Simple battery而且domestic violence。所以我现在好纠结，不知道该怎么办

个人认为现在这样可以了。只要能确定几年后没有案底。就是暂时不能出境。

Listen to the lawyer. Think about it, he charges you by the hour and who doesn't want to make more money.  Consider yourself fortunate, not all lawyers are honest as yours. In fact, not only you might be wasting money, you better be prepare for much worse outcome if you keep pursuing the case.


In any case, I think you can consult another lawyer for second opinion so that you won't regret your decision.  It's necessary only if you think there is a chance that the jury is going to believe you.....

嗯嗯，但是我总感觉现在的律师没有努力做什么事，目击者和我男朋友都没有上过庭。现在的律师在我在被bail out以后他们推荐的一个ABC律师，只会讲广东话，只收了3000的费用。我刚刚有打电话问了另外一个白人律师，在yelP上找的，听起来还挺有经验的。但是在trail之前要收7500。我不知道要不要换，会不会换起来很麻烦。

嗯嗯，我现在的律师在我在被bail out以后他们推荐的一个ABC律师，只会讲广东话，只收了3000的费用。我刚刚有打电话问了另外一个白人律师，在yelP上找的，听起来还挺有经验的。但是在trail之前要收7500。我不知道要不要换，会不会换起来很麻烦。他说要是接受我的案子，就会重新审理，制订方案，但是也不能保障说dismiss。

You need to be careful there.  Once the case goes on trial, experience helps, but it has more to do with the judge and jury which means it will also depend on your luck.

Many good lawyers won't take your case if it's not your best interest but other lawyers really don't care even if they think you might ending up going to jail. You need to ask yourself, does the lawayer really think he can help you, or is he simply going after your money?

I guess you already told the new lawyer about the plea deal.  Did you ask him about likely expected outcome and what are the chances?  And what would the worst expected outcome and what are the chances?  Will there be criminal records and/or jail time?

If you know the 'likely' and 'worst' expected outcome, you can weight them against the plea deal.

I suggest you to call more lawyers.  You will have a better understanding of the situation after getting answers from different lawyers.   And instead of hiring a lawyer, maybe you hire/pay for consultation only...

Try to find a lawyer with good Yelp reviews who is also a super lawyer (who has good reputation within their own circle).  You can find super lawyers on this site:
