HOW TO CLAIM A REFUND OF FICA (SOCIAL SECURITY) AND/OR MEDICARE TAXES WITHHELD IN ERROR
1. First, request the employer for a refund.
2. If the employer refuses:
a. Go to www.irs.gov and download:
(1) Form 843, Claim for Refund and Request for Abatement, (PDF) and Instruction for Form 843 (PDF).
(2) Form 8316, Information Regarding Request for Refund of Social Security Tax Erroneously Withheld on Wages Received by a Nonresident Alien on an F, J, or M Type Visa (PDF).
b. Complete Form 843.
c. Complete Form 8316.
d. Attach documentation described in the 843 instructions.
e. Attach a cover letter stating that the employer refused to refund the FICA (Social Security) and/or Medicare taxes withheld in error. Make sure to sign the cover letter.
f. Send the complete package to: Department of the Treasury Internal Revenue Service Austin, TX 73301-0215 Or, the Internal Revenue Service Center where you filed your return if different from above.
g. Make sure to keep a copy of the complete package for your record.
