Right To Control:

Provide a combination of the following or similar types of evidence This list is not inclusive of all types of evidence that may be submitted. You may submit any and all evidence you feel would meet the employer-employee requirement.

1. A complete itinerary of services or engagements that specifies the dates of each service or engagement, the names and addresses of the actual employer, and the names and addresses of the establishment venues, or locations where the services will be performed for the period of time requested;

2. Copy of signed Employment Agreement between you and the beneficiary detailing the terms and conditions of employment;

3. Copy of an employment offer letter that dearly describes the nature of the employer-employee relationship and the services the beneficiary will perform;

4. Copy of relevant portions of valid contracts related to the beneficiary's placement at the end-user worksite that confirms the role in which the beneficiary will be working while at the end-user worksite;

5. Copies of signed contractual agreements, statements of work, work orders, service agreements, and letters from authorized officials of the ultimate end-client companies where the beneficiary will perform the work, which provide information such as a detailed description of the duties the beneficiary will perform, the qualifications that are required to perform the job duties, salary or wages paid, hours worked, benefits, a brief description of who will supervise the beneficiary and their duties, and any other related evidence;

6. Copy of position description or any o. ther documentation that describes the skills required to perform the job offered, the source of the instrumentalities and tools needed to perform the job the product to be developed or
the service to beprovided the location where the beneficiary will perform the dunes the duration of the relationship between you and the beneficiary, whether you have the right to assign additional duties the extent of your discretion over when and how long the beneficiary will work the method of payment your role in paying and hiring assistants to be utilized by the beneficiary, whether the work to be performed is part of your regular business, the provision of employee benefits, and the tax treatment of the beneficiary in relation to you;

7. A description of the performance review process; and/or

8. Copy of your organizational chart, demonstrating beneficiary's supervisory chain.

In-House Employment

Provide evidence that you have specialty occupation work available for the- entire requested H-lB validity period. The following list contains suggested evidence that may be submitted. This list is not inclusive; you may submit other similar types of evidence that you feel will establish sufficient specialty occupation work.

1.Copy of relevant portions of valid contracts, statements of work, work orders, service agreements, and letters between you and the authorized officials of the ultimate end-client companies to whom the end product or services worked on by the beneficiary will be delivered;

2. Copy of position description Or any other documentation that describes the skills required to perform the job offered, the tools needed to perform the job, the product to be developed or the service to be. provided, the method of payment, whether the work to be performed is part of your regular business, the provision of employee benefits, and the tax treatment of the beneficiary by you;

3. Signed copies of your two or three most recently filed Federal income tax returns to include all required schedules and statements;

4. Copies of company brochures, pamphlets, Internet website, or any other printed work published by you which outlines, in detail, the products or services provided by your company;

5. Copies of critical reviews of your software in trade journals that describes the purpose of the software, its cost, and its ranking among similarly produced software;

6. Copy of the marketing analysis for your final software product; and/or

7. Copy of a cost analysis for your software product.
