RFE质疑Level 1 工资，那么能现涨工资吗？

如题，这种情况大家的律师都是怎么解释的？为了满足Specialty occupation 必须如实描述职位的专业性，但又说不通为什么只给Entry level 的工资。

根据美国公民和移民服务局（USCIS）的规定，Specialty Occupation需要符合以下四个条件中的一个：
1. A bachelor's or higher degree or its equivalent that is normally the minimum entry requirement for the position; he required degree must be related to the position to be filled.
2. The degree requirement is common to the industry, or in the alternative, the position is so complex or unique that it can be performed only by an individual with a degree;
3. The employer normally requires a degree or its equivalent for the position; or
4. The nature of the specific duties is so specialized and complex that the knowledge required to perform the duties is usually associated with the attainment of a bachelor's or higher degree.

目前根据USCIS内部的政策，如果只给Level I 工资，它就会假设你达不到第四个条件，你只能提供证据证明你满足其他三个条件之中的一个。
